Kibbits Terms of Service

What these terms are

These Terms of Service ("Terms") are an agreement between you (the user) and Kibbits ("we," "us," "Kibbits"). By installing, opening, or using Kibbits, you agree to these Terms. If you don't agree, please uninstall Kibbits.

What Kibbits is

Kibbits is an iOS application that turns real-world step counts into a virtual menagerie of pets. It is intended for personal, non-commercial use.

Kibbits reads step data from Apple HealthKit with your explicit permission. Kibbits does not track your location, your route, your heart rate, your weight, or any other health metric beyond step count.

Eligibility

You must be at least 13 years old to use Kibbits. If you are between 13 and 18 (or the age of majority in your jurisdiction), you should review these Terms with a parent or guardian.

Kibbits is not intended for children under 13, and we do not knowingly collect data from them. See privacy-policy.md for details.

Your account

Kibbits does not require an account. You don't sign up. You don't give us your email. Your usage data is anonymous and lives on your device.

If we ever introduce optional accounts (e.g., for cross-device sync to Kibbits-controlled servers), the Terms governing that account will be a separate, opt-in agreement.

Your data

Your health data stays on your device. Your pet collection lives on your device. We collect no crash reports and no analytics, so nothing about your usage leaves your device.

You can delete all your Kibbits data from within the app at any time (Settings → Delete everything).

What you can do with Kibbits

You may:

  • Install and use Kibbits on devices you own or are authorized to use
  • Use Kibbits for personal, non-commercial enjoyment
  • Share screenshots and screen recordings of Kibbits on social media and elsewhere

You may not:

  • Modify, decompile, reverse-engineer, or attempt to extract the source code of Kibbits (except as permitted by law)
  • Use Kibbits to commit fraud, harm others, or violate any law
  • Use automated tools, bots, or scripts to interact with Kibbits
  • Manipulate your step counts artificially to gain pets (technically possible, but not in the spirit of the app; we may silently suppress drops triggered by detected manipulation)
  • Distribute, sublicense, or resell Kibbits or any part of it

Intellectual property

Kibbits (the app, its illustrations, music, design, and code) is owned by Ishan Panta. All rights reserved.

You don't get any ownership over Kibbits by using it. You have a personal, limited, non-exclusive, non-transferable license to use the app as intended.

Pet portraits you generate within Kibbits and share publicly are yours to share. Don't sell them as commercial products without permission.

Purchases

Kibbits is free, and every part of it is free. There are no subscriptions and no ads. We do not sell pets, kibble, or any other in-app currency. Ever.

There is one optional purchase, the Supporter Pack, at $4.99 or the local equivalent. It is a one-time, non-consumable purchase that is cosmetic only: it unlocks no gameplay, no progression, no pets and no features. Nothing in Kibbits is withheld from you if you never buy it.

Apple or Google takes the payment under its own terms, and refunds are theirs to give under those terms, not ours. We use RevenueCat to check that a purchase is genuine and to restore it on a new device. Restore Purchase is in Settings, under Support Kibbits, and it needs the same Apple ID or Google account that made the original purchase.

(If we add any further purchase, these Terms will be updated to describe it before it ships.)

Acceptable use

We expect you to:

  • Use Kibbits for its intended purpose (a calm pet companion)
  • Respect other Kibbits users in any community spaces we operate (Discord, etc.) per the community guidelines posted there

We reserve the right to:

  • Refuse service or ban users who abuse community spaces or attempt to harm other users or the service
  • Refuse to honor in-app purchases that appear fraudulent (extremely rare)

Disclaimers

Not a medical or fitness service

Kibbits is not a medical device, a medical app, or a fitness coaching service. We do not provide medical advice. We do not diagnose, treat, cure, or prevent any condition. If you have health concerns or are starting a new exercise routine, consult a qualified healthcare professional.

The step counts Kibbits displays are read from your phone's health platform; we do not validate or correct them. Take them as approximate.

Service availability

Kibbits is provided on an "as is" and "as available" basis. We don't guarantee that:

  • The app will be uninterrupted or error-free
  • All features will work on every device
  • The app will be compatible with every future iOS version (we do our best)

We may discontinue Kibbits (or any feature) with reasonable notice if commercially necessary. If discontinued, we will provide a way to export your collection.

Third-party services

Kibbits integrates with Apple HealthKit and the Apple App Store. We are not responsible for changes to those services or their availability.

Limitation of liability

To the maximum extent permitted by law, our total liability to you for any claim related to Kibbits is limited to the amount you paid us, which is $0 (Kibbits is free).

We are not liable for:

  • Indirect, incidental, consequential, or special damages
  • Loss of profits, data, or pet collection

Some jurisdictions don't allow these limitations; in those jurisdictions, our liability is limited to the maximum extent permitted by law.

Indemnification

You agree to indemnify and hold harmless Kibbits, its developer, and any contractors from any claims arising from your misuse of the app or violation of these Terms.

Termination

You can stop using Kibbits at any time by uninstalling it, which deletes the data held on your device. We may suspend or terminate your access if you breach these Terms, which in practice would only apply to extreme abuse.

Changes, governing law and severability

We may update these Terms. Material changes will be announced in the App on next launch and published at kibbits.app/terms, and the "Last updated" date above will record the revision. Continued use after an update constitutes acceptance.

These Terms are governed by the laws of Nepal, and any dispute will be heard in the courts of Nepal. Where the consumer protection laws of your own jurisdiction grant you rights these Terms do not provide, those laws prevail and nothing here overrides them. If any provision is found unenforceable, the remainder stays in effect.

Kibbits is owned by Ishan Panta and distributed through the App Store and Google Play. Each store shows its own seller of record on the listing.
